Update: Complaint filed with the CA Department of Insurance:

My husband and I immigrated to the U.S. from the Philippines to live with my daughter, and later I became an American citizen.

We both took out Globe Life insurance policies on each other for $10,000 so we could have something to pass on to our children still living in the P.I. We both answered the questionnaire with complete honesty. At the time we took out the life insurance, my husband was still mowing the front and back lawns, and riding his bicycle around the neighborhood. He had never been to a doctor in his life, and had no medical history, which Globe Life did not request before issuing him the policy.

As with most people born and raised in the P.I., my husband had never seen or was ever treated by a certified M.D. Being a farmer from Isabella Provence, Luzon, he relied on home remedies passed down from generation to generation to take care of injuries and illnesses. There werenโ€™t many MDs (if any) around, anyway. Last December he passed away peacefully in his sleep due to atherosclerosis (coronerโ€™s report).

After sending Globe Life a copy of the death certificate in mid-January of this year, Globe Life sent a letter requesting my late husbands medical history.

We informed them that he had none, which is the truth. Again, they sent a second letter stating that they are waiting on his medical history before they can process the claim. Apparently, if one has a medical history they wonโ€™t pay, and if one doesnโ€™t have a medical history, they wonโ€™t pay as well (a win-win situation for them). Also, they are claiming that he died during the first two years, which is during the โ€œcontestableโ€ period.

They have not indicated what they are contesting.

So far, they have not come up with one piece of evidence that anything in his answers to the application questionnaire was misrepresented, or any proof of a prior medical history. Even in a third-world country like the P.I., a blatantly fraudulent company such Globe Life would not be permitted to operate.

Last December he passed away peacefully in his sleep due to atherosclerosis, which 80% to 90% of Americans over 30-years of age haveโ€”most not knowing they have it.

After sending a copy of the death certificate, Globe Life sent a letter requesting my late husbands medical history. We informed them that he had none, which is the truth. Again, they sent a second letter stating that they are waiting on his medical history before they can process the claim. Also, they are claiming that he died during the first two years, which is during the "contestable" period. We contacted a lawyer about this, and this is what he said about the contract:

There is no specific mention of what constitutes "Contestable". However, the following terms limit their ability to contest. Keep in mind that any court will interpret any ambiguity in the contract AGAINST the party who drafted it. Thus, their ability to contest is limited to misrepresentations in the Enrollment Form:

โ€ข The basis for this certificate is the information in the enrollment form. lncorrect information in the enrollment form could void the certificate or cause an otherwise valid claim to be denied. Advise Us immediately if any information is wrong or if any past medical history has been left out

โ€ข THE CONTRACT - This certificate, including the enrollment form, is the entire contract between You and Us. Any change must be made in writing by one of Our officers. All statements in the enrollment form are representations and not warranties. No statements shall be used to void this certificate or to defend against a claim unless contained in the enrollment form.

โ€ข DEATH BENEFIT PAYABLE. We will pay the proceeds of this certificate to the Beneficiary when We receive due proof that the lnsured's death occurred while this certificate was in force.
